Agreement to Terms

By accessing or using Warky Devs services, you agree to be bound by these Terms of Service and all applicable laws and regulations.

Services Provided

Warky Devs offers:

• Software development (web, mobile, desktop applications)
• Database-driven application development
• Hosting and infrastructure services
• API integrations and system integration
• Open-source tools and libraries
• Maintenance and continuous upgrade support

Service Agreements

• Scope: Services are provided as agreed in individual contracts or subscription terms
• Delivery: Timelines are estimates and may vary based on project complexity
• Changes: Scope changes may affect pricing and timelines
• Support: Ongoing maintenance and support terms are defined per agreement

Payment Terms

• Billing: Payment terms are specified in individual agreements
• Subscriptions: Subscription services are billed on recurring basis
• Late Payment: Overdue accounts may result in service suspension
• Refunds: Refund policies are defined per service agreement

Intellectual Property

• Custom Work: IP rights are transferred upon full payment unless otherwise specified
• Subscription Products: Warky Devs retains all rights to subscription-based products
• Open Source: Open source contributions remain under their respective licenses
• Client Materials: You retain rights to materials you provide

Client Responsibilities

• Provide accurate information and timely feedback
• Ensure you have rights to any materials provided
• Maintain confidentiality of access credentials
• Use services in compliance with applicable laws

Warranties and Limitations

• Quality: We deliver professional services using industry best practices
• No Guarantees: Software is provided "as is" without warranty of fitness for specific purposes
• Liability: Our liability is limited to the amount paid for the specific service
• Testing: Clients are responsible for final testing and acceptance

Confidentiality

We treat client information as confidential:

• We do not share project details with third parties
• NDAs are available upon request
• Source code and proprietary information remain confidential

Termination

• Either party may terminate with notice as specified in the agreement
• Outstanding payments remain due upon termination
• Access to subscription services ends upon termination
• Completed work deliverables are provided upon final payment

Hosting and Uptime

• We aim for maximum uptime but do not guarantee 100% availability
• Scheduled maintenance will be communicated in advance when possible
• Backups are maintained but clients are responsible for their own backup strategy

Governing Law

These terms are governed by the laws of South Africa. Any disputes will be resolved in South African courts.

Changes to Terms

We may update these terms. Material changes will be communicated to active clients. Continued use of services constitutes acceptance of updated terms.
